Morgan Coakle Privacy Policy

Morgan Coakle has adopted this policy to ensure that we handle personal information in accordance with the Privacy Act 2020 (the Act). The policy explains how we may collect, use, store and disclose personal information you or a third party provide to us.

What is personal information?

What personal information do we collect and hold?

The main types of personal information we collect and hold relates to the contact details and the roles of our clients, suppliers and other business contacts. Typically, this information includes names, addresses, telephone numbers, e-mail addresses and job titles. In the course of providing professional services to our clients, we may collect and hold more detailed personal information such as financial details if we are asked to handle client funds, or information collected as part of our AML/CFT obligations.

Directly from you

  • We will primarily obtain information directly from you via email, phone and in-person meetings.

From a third party

  • We may collect personal information about you from third parties, such as your insurer, broker, banks or an electronic verification provider.
  • It is important that you read the privacy policies for all agencies you deal with, as you may be permitting the sharing of personal information with us when using those services.

When we collect your information from a third party, we will take reasonable steps to ensure you are aware of:

  • The information that has been collected
  • Why we are collecting it
  • Who it may be shared with
  • The third party that the information is collected from.

We collect, hold and use personal information collected from you directly, or from a third party, for the following primary purposes:

  • To enable us to identify you to comply with our AML/CFT obligations
  • To fulfil our professional duties or comply with a legal or regulatory obligation
  • To keep you informed and updated about legal developments or other legal services.

Provision of personal information is voluntary; however, if you do not provide full and accurate information to us, it may impact on our ability to provide legal services to you.

 
How do we store the information?

Morgan Coakle will take all reasonable steps to ensure that the personal information we hold is protected against loss, unauthorised use, access, modification or disclosure and any other misuse by taking such security measures as it is reasonable in the circumstances for us to take.

Who may we disclose your personal information to?

In providing our services to you, we may disclose your personal information to third parties from time to time to ensure that we meet our legal and ethical obligations or where disclosure is required or permitted by law, regulation, rule or professional standard.

  • To meet legal and professional obligations.

If your personal information is no longer required by Morgan Coakle, we will securely destroy it.

 
How can you access and correct your personal information?

You may request access to any personal information we hold about you at any time by contacting our Privacy Officer (see contact details below).

We may refuse you access to personal information if (among other things):

  • Disclosing the information would disclose information about another individual;
  • The request is frivolous or vexatious or the information requested is trivial;
  • The information is not readily retrievable;
  • The information does not exist or cannot be found.

If we are able to provide you with the information requested and you believe that your personal information is not correct, you may ask us in writing to correct the information.

We may update this policy at any time by publishing the latest version on our website.
